A Kroy Biermann court order fight has spilled into another messy divorce, with Kim Zolciak’s boyfriend, Kyle Mowitz, asking a judge to keep the former NFL player away from his children, according to court documents obtained by TMZ.
Mowitz claims his estranged wife, Jillian Green, was not truthful during a deposition in their divorce about her relationship with Biermann, who is Zolciak’s estranged husband.
According to TMZ, Mowitz says Green testified that she and Biermann were only friends, had met one time and were not continuing to communicate. He also says Green testified she did not expect to have an ongoing relationship with Biermann and had no plans to bring him around her children.

Mowitz claims the situation changed months later when he allegedly found Biermann’s vehicle outside the family home while the children were there, according to the court filing cited by TMZ.
He also claims text messages produced in the divorce showed Green had far more contact with Biermann than she acknowledged under oath. Mowitz further alleges neighbors told him Biermann is often at the house.
In the filing, Mowitz says he is concerned by what he describes as Biermann’s “unpredictable behavior” and an alleged history of mental and physical abuse involving adults and children, TMZ reported. Mowitz is asking the court to block Biermann from the home and from being around his kids.
TMZ did not report a response from Green or Biermann to Mowitz’s claims.

According to Mowitz’s filing, Green allegedly presented her connection with Biermann as limited during the deposition. Mowitz now argues the later evidence, including the alleged vehicle sighting and text messages, tells a different story.
Mowitz also points to photos TMZ published earlier this year that showed Green and Biermann together in what the outlet described as a cozy encounter.
The court fight is tangled with the long-running fallout from Zolciak and Biermann’s split, as well as Mowitz and Green’s divorce. TMZ previously reported that Green subpoenaed Zolciak, a former The Real Housewives of Atlanta cast member, over gifts Mowitz allegedly gave her.
Green has also claimed Mowitz controls a trust worth more than $100 million, according to TMZ.
What else is Kyle Mowitz asking the judge to allow?
Green currently has exclusive use of the former marital home under a temporary court order, according to TMZ. Mowitz says he still has valuable wine and a weapons collection inside the property.
He is asking the court for permission to go into the house, remove the weapons, make an inventory of the wine and install a lock on the wine cellar.
The filing puts four names already tied to headline-making divorces into the same legal skirmish: Mowitz, Green, Zolciak and Biermann. For now, Mowitz’s request centers on whether the judge will restrict Biermann’s access to the home and the children while the divorce case continues.
